1. Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of Tim Brennecke (hereinafter "Seller") apply to all contracts concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller for goods offered in the Seller’s online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected, unless expressly agreed otherwise.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

1.3 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in exercise of their trade, business, or profession.


2. Conclusion of Contract

2.1 The presentation of goods, especially in the online shop, does not constitute a binding offer by the Seller.

2.2 The Customer places the selected goods in the shopping cart. In the next step, the ordering process begins, where all necessary data for order processing are collected. At the end, a summary of the order and contract data is displayed. By confirming these and clicking the button that completes the order process, the Customer submits a binding offer to purchase the goods in the shopping cart.

2.3 The Seller accepts the Customer’s offer by one of the following alternatives:

  • Sending a written order confirmation or a confirmation in text form (e.g., by email or fax),
  • Requesting payment from the Customer after the order has been placed,
  • or delivery of the ordered goods.

The decisive point in time is whichever of these alternatives occurs first. The period for acceptance begins the day after the Customer submits the offer and ends at the close of the fifth day thereafter. If the Seller does not accept within this period, the offer is deemed rejected.

2.4 If "PayPal" or "PayPal Express" is chosen as payment method, payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg ("PayPal"). The PayPal User Agreement is available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full. By clicking the final order button and authorizing payment to PayPal, the Seller already declares acceptance of the offer at this point.

2.5 The Seller stores the contract text. The Customer will receive all relevant contract data (order details, GTC, withdrawal policy) by email. If a customer account is created, the contract text can also be retrieved via login.

2.6 All entries can be reviewed and corrected before submitting the order using the browser’s back function or provided buttons.

2.7 The contract language is German.

2.8 The Customer is obliged to provide a valid email address and ensure that emails regarding the order can be received.


3. Prices and Payment Terms

3.1 All prices stated are final prices. The Seller is a small business within the meaning of § 19 para. 1 UStG and therefore does not charge VAT.

Any shipping costs are specified in the product description.

3.2 For deliveries outside the EU, additional duties, taxes, or fees may apply, which must be paid by the Customer to the competent authorities or institutions. It is recommended to inquire there beforehand.

3.3 The Customer can choose among the payment methods offered in the shop.

3.5 PayPal Checkout
If PayPal Checkout is used, payment is processed by PayPal. Third-party providers may be involved (e.g., Klarna, invoice purchase). A credit check may be carried out before acceptance. If the result is negative, the payment method may be refused.
Payment with debt-discharging effect is then only made to PayPal or the respective service provider.


4. Delivery and Shipping Conditions

4.1 Delivery is made to the delivery address specified by the Customer. For PayPal payments, the address stored there applies.

4.2 Incorrect information or delivery obstacles leading to additional costs are borne by the Customer – unless they are not at fault.

4.3 Self-collection is not possible.

4.4 Vouchers are provided to the Customer either by email, download, or post.


5. Right of Withdrawal

5.1 If the Customer is a consumer, they generally have a right of withdrawal.

5.2 The Seller’s separate withdrawal policy applies.

5.3 Customers residing and with delivery address outside the EU have no right of withdrawal.

5.4 No right of withdrawal exists for individually manufactured products (§ 312g para. 2 no. 1 BGB).


6. Retention of Title

The goods remain the property of the Seller until payment is made in full.


7. Liability for Defects

7.1 The statutory warranty rights apply, unless otherwise agreed.

7.2 The Customer is requested to report obvious transport damage directly to the deliverer and to inform the Seller. Failure to report does not affect statutory rights.


8. Liability

8.1 The Seller is fully liable for intent and gross negligence as well as for damages to life, body, or health.

In cases of simple negligence, the Seller is only liable for breaches of essential contractual obligations (cardinal obligations).

8.2 In other cases, liability is limited to foreseeable, typical contractual damage.

8.3 Further liability is excluded.

8.4 These provisions also apply correspondingly to the Seller’s vicarious agents and employees.


9. Indemnity for Infringement of Third-Party Rights

For custom-made products according to the Customer’s specifications, the Customer assures that no third-party rights are infringed. In case of damage, the Customer indemnifies the Seller and assumes necessary legal defense costs.


10. Redemption of Promotional Vouchers

10.1 Promotional vouchers issued free of charge with a validity period are redeemable only in the Seller’s online shop and cannot be purchased.
